Welcome to NiYA Jobs – a national platform operated by the Nigerian Youth Academy (NiYA), an initiative of the Federal Ministry of Youth Development (FMYD) and powered by Sapphital Limited. These Terms and Conditions govern your use of the NiYA Jobs platform (https://jobs.niya.ng/). By accessing or using the platform, you agree to be legally bound by these terms.

1. Introduction

NiYA Jobs is designed to connect employers and job seekers, enabling the posting and discovery of job opportunities across Nigeria. By accessing or using our services, you agree to comply with these Terms and Conditions. If you do not accept any part of these terms, you must not use the platform.

2. Definitions

  • NiYA Jobs: The official job portal of the Nigerian Youth Academy, operated at https://jobs.niya.ng/
  • User: Any individual or organization accessing the platform, including:
  • Candidates: Individuals applying for jobs
  • Employers: Companies or entities posting job opportunities
  • Operators: FMYD, Sapphital Limited, and their authorized partners
  • Services: All features, content, and tools available on the NiYA Jobs platform

3. Eligibility

Only individuals aged 18 years and above are permitted to use this platform.

Employers must be legally registered and authorized to recruit within Nigeria.

Users are fully responsible for ensuring the accuracy and legality of the information they provide, including age, education, and employment history.

The platform and its operators are not liable for any incorrect or misleading information submitted by users.

3. Eligibility

Use of the NiYA Jobs platform is subject to strict eligibility requirements to maintain trust, compliance, and integrity across all interactions. By accessing or using the platform, you affirm that you meet the following criteria:

For Candidates:

  • You must be a citizen of Nigeria.
  • You must be at least 18 years of age or older at the time of account registration.
  • You must possess at least one valid and verifiable official means of identification, such as a National Identity Number (NIN), Permanent Voter's Card (PVC), International Passport, or Driver’s License.
  • You must provide complete, truthful, and up-to-date personal information, including educational background, employment history, and contact details.
  • You acknowledge that you are solely responsible for the accuracy and legality of any data submitted and that false declarations may result in immediate account suspension or legal action.

For Employers:

  • You must be a legally registered business or organization in Nigeria, with a valid registration number issued by the Corporate Affairs Commission (CAC).
  • You must maintain an active corporate bank account in Nigeria under the registered company name.
  • You must provide accurate and complete organizational information, including your business name, registration details, contact person, and job posting information.
  • You affirm that all job opportunities posted are genuine, lawful, and in full compliance with Nigerian labor laws, anti-discrimination regulations, and ethical recruitment practices.

The platform and its operators (including the Federal Ministry of Youth Development, Sapphital Limited, and affiliated partners) shall not be held liable for:

  • Misrepresentations or false claims made by any user
  • Ineligible or fraudulent employers or candidates using the platform
  • Consequences resulting from user-submitted inaccuracies or unlawful activities

All users are fully responsible for their actions and declarations on the platform, and may face account termination, legal penalties, or referral to relevant authorities in the case of violation.

4. Account Registration & Responsibilities

To access the full features of the NiYA Jobs platform, all users—whether job seekers or employers—must create an account and adhere strictly to the registration and usage policies outlined below. The platform reserves the right to verify, suspend, or terminate any account that fails to meet these requirements.

A. For Candidates (Job Seekers):

Candidates must create a personal user account to apply for job opportunities.

Registration requires the submission of accurate personal and professional information, including full name, contact details, educational qualifications, work history, and job preferences.

Candidates must upload at least one official, government-issued means of identification (e.g., NIN slip, International Passport, Voter's Card, Driver’s License).

Candidates are strictly prohibited from impersonating others, using fake credentials, or submitting misleading information.

All login credentials must be kept confidential and secure. Sharing accounts or passwords with third parties is forbidden.

Candidates are fully and solely responsible for the accuracy, completeness, and legality of all data submitted. Any false declaration may result in account termination, blacklisting, legal prosecution, or referral to law enforcement agencies.

B. For Employers (Organizations/Recruiters):

Employers must create a verified company profile before posting job opportunities on the platform.

The following documents are mandatory at the point of registration:

  • Corporate Affairs Commission (CAC) Certificate of Incorporation
  • Official Company ID or Government-issued ID of the primary contact person
  • Corporate bank account details, including bank name and account number (used only for internal verification)
  • Tax Identification Number (TIN) (if applicable)

Employers must accurately describe each job posting, including job title, qualifications, job location, responsibilities, salary (where applicable), and closing date.

All job listings must comply with Nigerian labor laws, including anti-discrimination, wage protection, and ethical hiring practices.

Employers are strictly prohibited from posting:

  • Fake, fraudulent, or misleading job offers
  • Positions involving illegal activities or deceptive schemes
  • Content that discriminates based on race, gender, religion, ethnicity, or political affiliation

The platform reserves the right to reject, modify, or remove any job posting deemed non-compliant or inappropriate without prior notice.

Liability Disclaimer

NiYA Jobs, Sapphital Limited, FMYD, and their authorized partners are not liable for any claims, damages, disputes, or losses arising from:

  • False information submitted by users
  • Employment relationships formed through the platform
  • User misconduct or breach of legal obligations

All content submitted by users is considered user-generated and does not reflect the official views or guarantees of the platform or its operators.

5. Job Postings and Applications

To maintain the integrity, trust, and transparency of the NiYA Jobs ecosystem, all users—particularly employers—must adhere to the following strict rules regarding job postings and applications. The platform reserves the right to monitor, audit, and enforce compliance.

For Employers:

  • All job listings must fully comply with relevant Nigerian labor laws, employment regulations, and anti-discrimination policies.
  • Employers must not post fake, deceptive, misleading, or non-existent job opportunities. This includes testing job posts, vague listings, or using the platform to collect candidate data without intent to recruit.
  • When an employer successfully hires a candidate, they are required to report the hire through the platform’s designated feature or by notifying NiYA Jobs support.
  • Employers must capture all recruitment activities conducted via NiYA Jobs to support national workforce tracking and ensure accurate employment statistics.
  • Once an organization starts using the platform, all related job postings, recruitment updates, and hiring decisions must be processed through NiYA Jobs to ensure visibility, accountability, and proper data collection.
  • Employers are strictly prohibited from soliciting applications through NiYA Jobs and then moving the hiring process entirely off-platform without documentation.
  • Employers must not violate candidate privacy by using application data for any purpose outside of legitimate recruitment (e.g., resale of data, marketing, or third-party use without consent).
  • Employers must treat all candidate submissions with confidentiality and professional care.
  • NiYA Jobs reserves the right to suspend or permanently ban any employer found engaging in unethical or non-compliant recruitment practices.

For Candidates:

  • Applications submitted through NiYA Jobs are delivered directly to employers. The platform does not intervene in or influence hiring decisions, interviews, or salary negotiations.
  • Candidates are advised to exercise due diligence by researching companies, verifying job details, and avoiding offers that appear suspicious or too good to be true.
  • NiYA Jobs does not guarantee the quality, safety, or suitability of job listings nor the outcome of applications submitted.
  • When invited for interviews, candidates are responsible for verifying the legitimacy of the employer, confirming the interview location, and conducting appropriate research to ensure their safety and the credibility of the opportunity.
  • Candidates must be aware that each job application is at their own risk, and they must ensure their own protection and discretion when engaging with employers.
  • NiYA Jobs shall not be liable for job offers, interviews, contracts, or employment conditions resulting from listings on the platform.

Enforcement and Disclaimers:

  • The platform and its operators (including FMYD, Sapphital Limited, and designated partners) bear no liability for employment decisions, recruitment disputes, misrepresentations, or unethical conduct by users.
  • The platform reserves the right to audit, flag, suspend, or remove any job listing or user account found in violation of these terms, without prior notice.
  • Repeated offenses or confirmed misconduct may result in permanent blacklisting and possible referral to law enforcement or regulatory authorities.

Third-Party Communication Disclaimer
The platform provides built-in communication tools for seamless interaction between candidates and employers, and users are strongly encouraged to utilize these features for all recruitment-related correspondence. NiYA Jobs also includes a tracking system to monitor the various stages of the recruitment process, ensuring transparency, accountability, and a structured hiring experience.

The operators of NiYA Jobs are not responsible for any communication or negotiation that occurs outside the platform, including through WhatsApp, SMS, or unofficial emails. Users must verify all interactions and are fully responsible for the risks associated with such off-platform engagements.”

Non-Solicitation and Spam
Users shall not use the platform to solicit for unrelated services, send spam messages, or promote external businesses. Such activities may result in immediate suspension or legal action.

Verification Clause (for Both Candidates and Employers)
The operators of NiYA Jobs may carry out background verification checks (automated or manual) on submitted documents or job listings to protect platform integrity. Users consent to such verification as a condition for continued use.

Data Usage Consent for Analytics
Users agree that anonymized data may be used by NiYA, Sapphital, or FMYD for platform optimization, policy formulation, and national employment statistics, without further notice.

Dispute Resolution Advisory
Any disputes between candidates and employers arising from job listings must be resolved independently. NiYA Jobs is not obligated to mediate such matters but may assist in providing contact evidence where necessary.

 

6. Fees and Payments

NiYA Jobs is currently free for all candidates to register, search, and apply for job opportunities.

For employers, the platform may offer free basic services; however, fees may apply for enhanced offerings such as:

  • Premium job listings
  • Featured employer placements
  • Advertisement slots
  • Increased visibility and targeting
  • Advanced recruitment tools or analytics

In addition, the platform operators reserve the right to charge a commission on successful recruitments, which may be calculated as a percentage of the hired candidate’s gross monthly or annual salary. The specific commission rate will be determined by the platform and disclosed in the employer’s dashboard or agreement terms at the relevant point in the hiring process.

NiYA Jobs, its operators, and technical partners reserve the full right to introduce new paid features, adjust service tiers, or modify pricing structures at any time, with or without prior notice. While we will make reasonable efforts to inform users of such changes, users are responsible for checking the platform for updates regarding fees and billing policies.

Use of any paid feature implies acceptance of the applicable charges, and failure to comply may result in suspension or restriction of services.

 

7. Prohibited Conduct

To maintain a safe, lawful, and professional environment, all users - candidates, employers, and visitors - must strictly comply with the following conduct rules. By using NiYA Jobs, you agree not to engage in any of the following activities:

A. False Information and Misrepresentation

  • Submitting false, misleading, or deceptive information, including fake identities, qualifications, company details, or job listings
  • Impersonating any individual or organization
  • Misusing the platform to collect personal data under false pretenses

B. Unauthorized or Illegal Use

  • Using the platform for any purpose other than legitimate job searching or recruitment
  • Engaging in fraudulent hiring practices, scams, pyramid schemes, or unauthorized solicitation
  • Bypassing or attempting to bypass platform processes, including external recruitment that circumvents platform usage and fee obligations

C. Content Violations

  • Uploading or sharing any inappropriate, offensive, or illegal content, including but not limited to:
  • Pornographic, sexually explicit, or suggestive images or videos
  • Content promoting violence, hate speech, or discrimination
  • Content containing malware, phishing links, or harmful code
  • Unauthorised use of logos, trademarks, or intellectual property

D. Harassment and Abuse

  • Harassing, threatening, or abusing other users through the platform's communication tools
  • Sending spam messages, promotional materials, or irrelevant job inquiries
  • Attempting to coerce or pressure candidates or employers beyond standard recruitment communication

E. Security and Platform Integrity

  • Attempting to hack, reverse engineer, scrape, or damage any part of the NiYA Jobs platform
  • Sharing or selling access credentials
  • Introducing viruses or malicious software

Consequences of Violation

Any violation of the above rules will result in immediate suspension or permanent banning of the user account. Additionally, such actions may be reported to appropriate regulatory, legal, or enforcement authorities, and may result in civil or criminal penalties.

NiYA Jobs, Sapphital Limited, FMYD, and all partners reserve the right to monitor, investigate, and take legal or administrative action against any form of misuse or non-compliance.

8. Intellectual Property

All platform content, including logos, designs, code, and materials, are the intellectual property of NiYA, FMYD, or Sapphital Limited. You are granted a limited, non-exclusive right to use the platform for lawful recruitment purposes. Unauthorized copying, resale, or use is strictly prohibited.

Users shall not modify, reverse engineer, disassemble, reproduce, or attempt to derive source code from any portion of the platform. Any unauthorized use of intellectual property may result in legal action, damages, or criminal liability under Nigerian and international IP laws.

9. Data Protection and Privacy

All data is processed in accordance with the Nigerian Data Protection Act, 2023. By using this platform, you agree to the collection, processing, and use of your data as described in our Privacy Policy. You are responsible for reviewing and understanding this policy.

Users are expressly prohibited from attempting to harvest, scrape, export, or misuse personal data accessible on the platform, whether manually or via automation. Such violations will result in immediate account termination and legal prosecution under applicable data protection laws.

10. Limitation of Liability

NiYA Jobs, its operators, the FMYD, and Sapphital Limited expressly disclaim any liability for:

  • Errors, omissions, or misrepresentations in user-submitted content
  • Hiring decisions made by employers or expectations of candidates
  • Any direct, indirect, incidental, or consequential damages resulting from use or misuse of the platform
  • External factors such as internet outages, data breaches, or third-party platform failures
  • Any legal or financial claims resulting from user negligence or misinformation

You agree to indemnify and hold harmless NiYA, FMYD, Sapphital Limited, and all affiliates from any claim, loss, or expense (including legal fees) arising from your use of the platform or breach of these Terms.

The platform and its operators do not warrant the uninterrupted availability or error-free operation of the platform. Users agree that platform downtime, maintenance activities, or unexpected system failures shall not be grounds for claims, refunds, or liability.

11. Termination

NiYA reserves the right to suspend or terminate any user account at its discretion, especially in cases of:

  • Policy violations
  • Abuse or fraudulent activity
  • Security threats
  • Legal non-compliance

Users may also deactivate their accounts upon request. Termination does not limit the operator’s rights to pursue claims or enforce terms.

Suspended or terminated users are prohibited from re-registering under a different identity, company name, or email. Any such circumvention will result in a permanent ban and potential legal consequences.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute shall be subject to the exclusive jurisdiction of Nigerian courts. Users waive all rights to challenge jurisdiction or venue in Nigeria.

Users agree to comply with all applicable Nigerian laws, including but not limited to labor laws, anti-fraud statutes, and data privacy regulations. Non-compliance may trigger regulatory reporting and criminal proceedings.

13. Amendments

NiYA, its operators, and authorized partners reserve the full right to update, modify, or revise these Terms and Conditions at any time, without prior or post-change notification to users. Users are solely responsible for reviewing the Terms periodically to remain informed of any changes.

We are under no obligation to individually notify users of updates. Continued access to or use of the platform after any changes constitutes your automatic and binding acceptance of the revised Terms.

If you do not agree with any updates, you must discontinue use of the platform immediately.

14. Compliance and Audit Rights

The platform reserves the right to audit any user account, employer activity, or job posting for compliance with these Terms, either manually or through automated tools. Refusal to cooperate with such audits may result in suspension or termination of access.
